Child Support for Mother

FAMILY LAW CASE

Our client retained us for a challenging child support matter. She has two teenage sons who she had been primarily supporting on her own with little or no help from the children’s father. The defendant is a self employed contractor and consistently insisted that he had little or no income due to the loss he reported on his tax return. The courts consistently believed the defendant awarding child support in the very low amount of $50.00 per week.

After substantial litigation and discovery of numerous bank accounts which had never been disclosed we negotiated a settlement of over $28,000.00 in back support which included attorney’s fees as well as requiring the defendant to pay one half of their sons braces as well as ½ of all extra-curricular activities. The client was ultimately awarded $275 per week in child support in addition to the above relief.

Child Support & Custody for Father

FAMILY LAW CASE

My client recently faced a challenging situation concerning his parenting time, which was lost due to the child’s mother making false allegations that he was driving impaired while the child was in the vehicle. This claim was fabricated, stemming from my client’s concerns about the child’s safety, particularly regarding the mother’s boyfriend, who has a history of numerous criminal complaints and final restraining orders.

During the hearing, we successfully demonstrated that the mother was not truthful in her allegations. As a result, we were able to secure additional parenting time for my client beyond what he previously had, as well as increased parenting time during the holidays.

Additionally, my client has been paying child support above the amount specified in the guidelines. When the mother insisted on recalculating the child support, we were able to provide evidence of overpayment on my client’s part. Nonetheless, my client’s primary focus remains the well-being of his child, and he agreed to continue paying the same support amount to ensure stability for the child.

Child Custody for Extended Family

FAMILY LAW CASE

My client, the sister of the child’s natural mother, obtained custody of the infant when the child was approximately six months old. This arrangement was necessary due to the mother’s lack of interest in the child and both parents’ struggles with serious mental health disorders.

Over the next two years, there were numerous court hearings concerning the father, who faced significant mental health challenges and disabilities as he sought custody. The Division of Child Protection and Permanency became involved to investigate the situation and ultimately concluded that the father was unable to provide adequate care for the child.

After several hearings spanning multiple years, we successfully secured sole custody for the aunt. Since taking custody, she has ensured that the child receives all necessary services. Notably, the child has been diagnosed with autism, along with substantial developmental delays and learning disabilities. The aunt’s commitment to the child’s well-being and access to appropriate resources has been instrumental in supporting her development.

Property Division for Wife

FAMILY LAW CASE

My client was involved in a long-term marriage lasting over 20 years, during which both she and her husband co-owned a successful business. The situation changed when the husband initiated an extramarital affair and began dissipating substantial marital assets.

In response, a complaint was filed to add the third party to the action, which was granted. Ultimately, the wife successfully negotiated a significant settlement concerning the valuation of the business and their shared property. This settlement amounted to a substantial financial award that will sustain her for the rest of her life.

Importantly, she was also able to retain her earned pension, which she accrued during the marriage, and was not required to turn it over. This outcome has provided her with the financial security necessary to move forward.

Domestic Violence

FAMILY LAW CASE

My client was charged with second-degree aggravated assault for an incident in which she cut her ex-boyfriend, the father of her child, in the neck following an argument. This incident occurred against the backdrop of a long history of domestic violence perpetrated by the boyfriend against her.

After several months of discussions with the state and presenting comprehensive information from our domestic violence expert, we successfully negotiated a probationary sentence for my client. This outcome was justified by her history as a victim of domestic violence, which played a significant role in the context of the altercation.

The probationary sentence allows my client to avoid incarceration while acknowledging the complexities surrounding her situation as a survivor of domestic abuse.

What You Need to Know

How long will a divorce take in NJ?

There is no definitive timeline, as it can vary significantly depending on the circumstances. However, if both parties are able to reach a settlement without going to trial or requiring court intervention, the process may take just a few months.

The duration also depends on the county where the complaint was filed. Some counties have significant backlogs, which can delay the process, especially if no agreement is reached.

Additionally, the timeline can be influenced by how effectively the parties negotiate and whether the attorneys are working cooperatively to help facilitate a resolution.

Bonnie is collaborative when possible and solution-oriented in her approach. However, she is always willing and prepared to advocate vigorously for her clients in the courtroom when necessary to achieve their goals.

If a settlement cannot be reached, the process may take up to a year or longer.

Do I have to prove fault to get a divorce in New Jersey?

No. New Jersey allows for no-fault divorce based on irreconcilable differences. That means that you only need to show that the marriage has broken down for at least six months. You can still file on fault-based grounds, but doing so rarely changes the outcome and it is uncommon. 

Can we get divorced without going to court in New Jersey?

You must still file in court to finalize your divorce in New Jersey. New court directives allow for Divorce on the Papers. A substantial amount of the counties in New Jersey are allowing for final hearings via Zoom.
